Michael Bartolic represents executives, managers and other professionals in all aspects of ERISA litigation, and with respect to executive compensation and benefits.  He represents executives and directors, managers, brokers, traders, investment advisors, attorneys, physicians, educators, and other employees in ERISA § 502 litigation over a denial of a claim for benefits, and breaches of fiduciary duty.  He is devoted to helping employees obtain and protect the compensation and benefits they have earned. 

Michael is a principal in The Law Offices of Michael Bartolic, LLC.  He founded the firm in 2009 after leaving a large multinational law firm based in Chicago where he worked on ERISA litigation regarding benefits disputes and fiduciary responsibilities. 

Michael is actively involved in the American Bar Association Section of Labor and Employment Law Employee Benefits Committee, and the Section of Taxation Employee Benefits Committee, newly appointed to a post on the subcommittee on legislation.  He is also a member of the Illinois State Bar Association Section Council on Employee Benefits, a small group of employee benefits attorneys in Illinois appointed by the ISBA President to contribute to the advancement of the employee benefits practice in Illinois, and he was recently appointed as Editor of the Newsletter for the Section Council on Employee Benefits. He has also served as a teaching assistant of a graduate level employee benefits law course at the John Marshall Law School’s Center for Tax Law and Employee Benefits in Chicago.  He has published several works in the School’s publication, TaxEB InBrief, and is currently developing an article regarding fiduciary responsibilities of avoiding benefit restrictions under the Pension Protection Act of 2006.

When Michael is not at the office, you might find him at U.S. Cellular field cheering for the White Sox or playing fetch with his retriever.  In the winter, Michael likes to hunt pheasant and quail with his dog.

Miller v. State, No. CR 08–1413, currently before the Alabama Court of Criminal Appeals
Mr. Bartolic represents a death row inmate in Alabama in post–conviction proceedings. He has raised arguments, and presented evidence at a formal hearing, showing that the inmate received ineffective assistance of counsel at his pre–conviction trial and sentencing. Had he received even minimally effective assistance of counsel, the inmate would have either been found not guilty by reason of insanity due to his PTSD with episodes of disassociation, or the Court would have sentenced him to life imprisonment, rather than the death penalty.
