When Does a Person Qualify for Long Term Disability in Illinois?

Long term disabilities affect victims for an extended period of time. They can result from accidents, illnesses, or chronic health conditions. They can impact people of all ages, preventing them from working and providing for their families. Long term disability benefits available through your employer can help offset your losses in income. To protect your rights to these benefits, it is best to be informed. Your long term disability attorney can help you determine when you may qualify for long term disability in Illinois.

Your Long Term Disability (LTD) Benefits

The Centers for Disease Control and Prevention (CDC) report that roughly 20% of all Illinois residents suffer from a long term disability. When these are severe enough to prevent you from working or performing important tasks on your job, you need to be aware of options that can help offset the lost income you suffer as a result.

Depending on your condition and the amount of time you spent in the workforce, you may be entitled to disability benefits through the Social Security Administration (SSA). Eligibility tools offered through the SSA provide guidelines in regards to eligibility and the amount of benefits you may be able to receive. You may also be entitled to disability benefits through your job, which are often included as part of your overall employee compensation package. These can generally provide you with up to three-quarters of your lost income if you meet eligibility requirements that are listed in your LTD insurance policy documents.

Qualifying for LTD Insurance Benefits

One of the first steps in determining whether you are eligible for long term disability insurance benefits through your employer is to carefully review all policy-related documents. Under the Employee Retirement Income Security Act of 1974 (ERISA), a federal law that governs employer-provided benefits, your employer must provide a copy of these documents for free if you ask for them. Generally, there are several criteria you must meet in regards to eligibility:

  • You must have been employed with the company for a period of time;
  • You must have been enrolled in their LTD insurance policy for a certain period;
  • You must have a qualifying medical condition that entitles you to LTD benefits;
  • Your condition must be thoroughly documented by a doctor;
  • You must be unable to work for a period of one year or more.
